PADDOCK TORONTO — ADULT PARTICIPANT AGREEMENT, ASSUMPTION OF RISK AND RELEASE

IMPORTANT: PARTICIPATION INVOLVES RISK OF SERIOUS INJURY. YOU ACCEPT THE STATED RISKS AND TAKE RESPONSIBILITY FOR YOUR ACTIONS AND FORCE-SETTING CHOICES, SUBJECT TO THIS AGREEMENT'S LEGAL LIMITS.
THIS AGREEMENT INCLUDES A RELEASE OF CERTAIN LEGAL CLAIMS, INCLUDING CLAIMS ARISING FROM NEGLIGENCE. READ SECTION 4 CAREFULLY. ASK QUESTIONS BEFORE SIGNING.
1 Operator and covered session
This agreement is between me, the adult participant identified below, and Paddock Toronto (the Operator), at 105 Gordon Baker Rd, Unit 105, North York, ON M2H 3P8.
It applies only to my preparation for, participation in, and entry to or exit from the simulator area for the session or booking identified below (the Activity). It does not automatically cover later bookings, food or beverage purchases, or unrelated activities.
2 Risks of high force sim racing
I understand that a simulator is physical equipment, even though the race is virtual. Direct-drive steering and force-feedback pedals can exert strong, sudden or unexpected forces. Risks include:
• The steering wheel rapidly turning, kicking back or resisting movement, causing fingers, hands, wrists or arms to be struck, twisted, trapped or strained; injuries can include cuts, sprains, dislocations and fractures
• Forceful pedal movement, resistance and moving parts causing pinching, foot or leg strain, or other injury; loose hair, jewellery or clothing becoming caught in equipment
• Pain, fatigue, dizziness or nausea; loss of balance while getting into or out of a rig; and slips or trips around seats, platforms, cables, belongings or spills
• Unexpected movement or force from equipment, electronic or software faults, incorrect setup, or mistakes by me, other participants or staff
Some injuries may be serious or cause lasting impairment. I voluntarily accept the stated risks, subject to this agreement's legal limits. Increasing force can increase strain and injury risk. A lower setting does not remove all risk.
3 My responsibilities and safety obligations
During your orientation, staff will show you the stop button on the right side of your simulator and explain how to use it. Do not begin until you understand the stopping procedure.
I take responsibility for my own actions, for following the demonstrated instructions, and for my force-setting choices, subject to the legal limits in section 4. I understand that I can adjust the force. I will ask staff to explain the controls before starting, choose a manageable force level, follow staff instructions, and never bypass safety features or interfere with another rig. I will not try to stop a freely rotating wheel by grabbing it.
I will secure loose hair, clothing and jewellery, keep food and drinks away, and not participate while impaired. I will ask for needed assistance. If I feel pain, excessive force, dizziness or discomfort, or notice a fault, I will use the demonstrated stopping procedure and alert staff. I may stop at any time; staff may end unsafe participation.
4 Release of claims including negligence
In exchange for being permitted to take part in the Activity, and to the extent permitted by Ontario law, I release the Operator and its directors, officers and employees acting in connection with the Activity (the Released Parties) from claims that I may otherwise have for personal injury, illness, death, property damage or related loss arising from the Activity, INCLUDING CLAIMS CAUSED BY THE NEGLIGENCE OF A RELEASED PARTY.
The release includes negligence in instructing or supervising participants, selecting force settings, setting up, inspecting or maintaining the simulators and the simulator area, and warning about Activity-related hazards. It includes duties under Ontario's Occupiers' Liability Act only to the extent those duties may lawfully be restricted or excluded.
This release does not cover gross negligence, reckless conduct, intentional wrongdoing, or any liability or statutory right that cannot lawfully be excluded. It does not release another person's independent rights or claims. It does not prevent a court or other competent body from deciding whether this agreement is valid or applicable.
5 Understanding and electronic agreement
Ontario law and applicable Canadian law govern this agreement, without removing any mandatory rights or remedies. If a provision is invalid, the remaining provisions apply only to the extent they can lawfully operate independently.
I am signing for myself. I have had a reasonable opportunity to read the entire agreement, ask questions and decide whether to participate. By deliberately typing or drawing my signature and selecting the acceptance control, I intend to sign this exact version electronically. A paper signing option may be requested from staff.
Privacy and agreement records
Paddock Toronto collects your name, email address, session details, acknowledgments and signature, together with the submission date/time and technical record identifiers, to identify the participant, record this agreement, administer the session, provide an agreement copy and address legal or insurance matters.
These records are processed and stored using Wix and its service providers. Access is limited to authorized personnel and service providers who need the records for these purposes. Relevant records may also be provided to professional advisers, insurers or authorities when reasonably necessary for a claim, legal obligation or other lawful purpose.
Records will be kept only as long as reasonably necessary for these purposes, taking account of applicable legal requirements, limitation periods and insurance needs, and then securely deleted or anonymized. Signing this agreement does not provide consent to marketing, photography or video.
6 Participant confirmations and signature
Read the entire agreement before signing. Each confirmation and the signature must be completed personally by the adult participant. No boxes are preselected.
